Nature of Case kathryn podraza and her husband, terrance podraza, brought suit against new Century physicians of nebraska, llC (new Century), to recover for injuries allegedly sustained after new Century's physicians failed to timely discover her appendicitis during two visits to the emergency room at lakeside Hospital in omaha, nebraska. lakeside Hospital is owned by alegent Health (alegent), but its emergency rooms and urgent care centers are staffed by physicians employed by new Century. the podrazas settled their claims with alegent. the principal issue in this case is whether the release agreement between the podrazas and alegent operates to bar the current suit against new Century.
